Summary of the D.O.T.'s Evaluation of the TurboFlare 360:

1.      Due to the TurboFlare 360 being manufactured for use intended to safeguard motor vehicles and highway users, the TurboFlare 360 is considered "Motor Vehicle Equipment", and the D.O.T. recognizes that it will be used as such.
2.      Federal Motor Vehicle Safety Standard Rule 125 is a set of requirements governing many warning devices. However, due to the TurboFlare 360 having a self-contained energy source (i.e. being a battery operated device), the TurboFlare 360 is exempt from these requirements.
3.      Due to the D.O.T. ruling the TurboFlare 360 as "Motor Vehicle Equipment", and recognizing that the TurboFlare 360 will be used as a roadside safety device, the product cannot contain safety defects in the manufacturing without issuing a recall and replacement of the product at no charge to the customer. This safety standard applies to all "Motor Vehicles" and "Motor Vehicle Equipment", including battery-operated devices such as the TurboFlare 360.

Since the Department of Transportation has officially determined the TurboFlare 360 to be "Motor Vehicle Equipment", this product is allowed to be contained within a motor vehicle, and used as a motor vehicle accessory to safeguard motor vehicles and highway users.
